President of the Republic, Ilir Meta through letter no.3115 prot, dated 15 September 2020, has identified the problems, anomalies and unjustified delays, while requesting the implementation of the Constitution and the Law, as well as taking emergency measures to make the Constitutional Court and the Supreme Court functional.
This letter was forwarded to the Justice Appointments Council (KED), the High Judicial Council (HJC), the Albanian Parliament and the Ombudsman, and it contains the official stance of President Meta “On delays and problems in the renewal and functioning of the Constitutional Court and the High Court”.
In respect of the principle of transparency that has always accompanied the activity of the Head of State, this position is published on the official website of the Institution.
“The President of the Republic, in his capacity as Head of State (Article 86 of the Constitution); the body for naming the appointment of judges of the High Court (Article 136 of the Constitution); the body for naming the appointment of three members of the Constitutional Court and the selection body by drawing lots of the members of the Justice Appointments Council 2020 (Article 149 / di Constitution), has closely followed the entire activity of the Justice Appointments Council in the years 2019-2020, and through this letter wants to address again before the KED and with the attention and knowledge of all institutions involved, on the problems and delays created in filling vacancies in the Constitutional Court and the High Court.
The activity of the KED and the HJC, unfortunately, is not moving at the required pace, leading to other unjustified delays in the process of re-establishment and functioning of the Constitutional Court and the High Court of the Republic of Albania.
The President of the Republic has repeatedly addressed both the KED and the HJC, both publicly and in writing, regarding the identified problems.
Although the renewal of the Constitutional Court is one of the 15 conditions of the European Union for the launch of the accession negotiation process and a vital need for Albania, it still seems that this is not understood correctly, as long as this issue does not seem to have received due attention, both by the KED and by the HJC,” President Meta stated among other things in the letter. /abcnews.al
