The HJC has accepted the request of ILD for the dismissal of the judge of Fier, Roland Hysi, who was sentenced by the court to 3 years in prison, as well as the removal of the right to exercise public functions for a period of 5 years. The judge of Fier was denounced two years ago by an investigative show after he received 500 euros and asked a woman for sex to decide in favor of child custody.
From the disciplinary investigation conducted by the High Inspector of Justice, it is proven that:
Judge R.H. has been found guilty of acts which, by their nature, are of the most serious degree, such as corrupt acts related to the exercise of the function of a judge.
The actions of R.H. have severely discredited the figure of the judge, his image in public, and have reduced the public’s trust in the figure of the judge and the judiciary. This is because the defendant sought and accepted bribes in his favor and benefited from it because of his duty as a judge and at the same time sought sexual favor from a litigant.
The actions of the judge have affected the regular activity of the judiciary by the irregular actions of outsiders, but also by the actions of himself as a justice official.
The criminal offense was committed with direct intent, with the main motive of obtaining a considerable monetary amount, as well as seeking sexual favors against the issuance of a civil decision, in favor of one party in the trial by Judge R.H.
When the disciplinary violation committed is so serious as to make the magistrate unsuitable or unworthy to continue his function, then the disciplinary measure can no longer play an educational role.
