The Special Court of Appeals overturned a first-instance court ruling on former Minister Saimir Tahiri after he was convicted of an offense for which he has not been charged.
As journalist Glidona Daci reports for abcnews.al, the Special Court of Appeals has argued that the court of first instance has convicted Saimir Tahiri on charge abuse of duty, an offense for which he has not been charged.
According to her, the prosecution has investigated former Minister Tahiri for involvement in a criminal organization, which makes him responsible for all criminal offenses committed by this organization.
The court of first instance has violated the Code of Criminal Procedure, because of the new charges against Tahiri, for which he has not been investigated.
The Special Court of Appeal also argues that the decision of the court of Catania in Italy, to terminate the investigation against Saimir Tahiri, can not be taken as evidence during the trial, as it does not meet the legal requirements as such.
Now the case of Saimir Tahiri after 3 years will be returned for retrial from the beginning as the former minister has considered this decision unfair./abcnews.al
