The head of the Socialist Party group, Bledi Çuçi, was asked about the mandate of the socialist deputy Olta Xhçka, where he said that a second opinion from the Venice commission is needed.

He further said that the Constitutional Court cannot impose the MP on the basis of the Constitution, as the latter is independent.

“I think the issue of the Parliament’s report with the Constitutional Court is a report that clearly defines it.

To annul any decision, act taken by the Assembly if it deems it to be contrary to the Constitution. It is the last interpretation of the Constitution of Albania. There was a court decision that abolished two Assemblies. In this particular case, an ambiguity has been created regarding the fact whether one MP or all MPs should vote or not.

This is a debate that has not been addressed by the Constitution, the Constitution in our judgment has tried to create a new norm, which the Constitution does not allow.

The court verifies the existing norms whether they are in accordance or not. The constitution says that the deputy is not even responsible for his vote. Article 73 says it, so the MP is not responsible for the vote. If there is a debate about whether what I say is right or not, we have decided to resolve this impasse with the Constitutional Court to ask the Venice Commission for an opinion. In this impasse, we will have to have an interpretation at the Venice commission.

The constitutionalist had the opportunity to address the public interest whether she should keep the deputy Xhaçka or not. We have to get an opinion, as there is a constitutional conflict at this point,” he said.
