The Court of General Appeals decided that the seal and direction of the democratic party should pass to the Reestablishment group represented by Sali Berisha. The three judges of the Appeal decided to reject the appeal of the legal representatives of Lulzim Basha who sought the annulment of the decision of the judge Agron Zhukri that in March 2022 recognized the re-establishment group as the legal representative of the Democratic Party.
Judges Alma Ahmeti, Iliba Bezati and Elona Toro did not accept the appeal of the legal representatives of Lulzim Basha, leaving in force the decision of the Court of First Instance made by Judge Agron Zhukri.
With the decision given on Tuesday, the clash between the two groups for the seal of the Democratic Party between Lulzim Basha and Sali Berisha, which continued for more than two years, ends. In Tuesday’s session, the legal representatives of Lulzim Basha asked the Court of Appeal to overturn the decision of Agron Zhukri, and on the other hand, those of the re-establishment left this decision in force and the non-acceptance of Basha’s representatives as a party in the process. Now the stamp and logo that has been used by Lulzim Basha so far must be handed over to the party that will be led by Sali Berisha.
The latter will have to use on the party’s flag the symbol that Lulzim Basha has carried until now. After the decision given in the first instance in March 2022 by judge Agron Zhukri that recognized the re-establishment group, the representatives of Lulzim Basha asked the Appeal to annul the decision.
The Court of Appeal on March 3, 2023 accepted the request of the representatives of Lulzim Basha, but then the re-establishment group asked the Supreme Court to overturn this decision.
Last December, the high court returned the file to the appeals court, but with another panel. Thus, the body headed by Alma Ahmeti, and the two members Elona Toro and Iliba Bezat finally gave the direction of the democratic party to the re-establishment group led by Sali Berisha. Judges Ahmeti and Toro have been confirmed at both levels of vetting, while the other judge Iliba Bezat will appear before the special appeal commission on the 26th after the confirmation in office from the first level has been appealed by the public commissioner.
The last session in the special appeals commission scheduled to be held on June 3 was not held because the representative of the international Monitoring operation was not present and requested to closely monitor the process./abcnews.al
