“June 30”, begins the session in the Constitutional, Association of Municipalities: Venice opinion has contradictions

The plenary session for “June 30” has started in the Constitutional Court where the opinions of the Venice Commission will be discussed. The trial panel is expected to make the final decision on the June 30, 2019 elections, whether or not they were legitimate.

Meanwhile, the president of this court, Vitore Tusha, during her speech said that the “Constitutional Court” has ascertained the decrease of the reason for the suspension and decided to hold the session.

The legal representative of the association of municipalities, Jordan Daci, speaking for “Venice” said that their opinion is not binding and there have been contradictions.

“This opinion is not binding on the Constitutional Court as a whole. There have been opinions and contradictions. Referring to the law, the Constitutional Court must adjudicate the case. We consider that the Commission is not correct, that it has no jurisdiction to adjudicate June 30. If the Constitutional Court does not have it, who has it? How can you go to Strasbourg if the issue does not go to the Constitutional Court? ” argued Jordan Daci.

Recall that the Constitution addressed “Venice” to obtain an opinion on this issue. The latter, with a response a few days ago, upheld the June 30 elections, arguing that the CC has no competence to assess their validity.

The preliminary opinion of the Venice experts states that the boycott of political parties as happened with the PD and LSI does not constitute a legal reason to question the periodicity of the elections that according to the constitution are held every 4 years.

We remind you that the lawsuit came from the association of municipalities led by Voltana Ademi that seeks the invalidity of local elections, arguing that the President of the Republic annulled the decree to hold them, while the opposition boycotted them and in half of the municipalities there was no race.
