The file for the investigation of the former Minister of Defense Fatmir Mediu has been transferred to SPAK. Sources inform ABC that for several days the Supreme Court has taken Mediu’s file to the Special Anti-Corruption Prosecution.
The transfer was made after the decision of the Court of Appeals to reopen the trial against the former minister in the “Gerdeci” case. The SPAK must now act by registering the investigation, to decide whether to conduct frequent investigations or take the matter to a merits trial.
“The Special Prosecution Against Corruption and Organized Crime, pursuant to decision no. 205, dated 24.09.2021, of the Special Court of Appeal, after withdrawing from the High Court the acts of the criminal file against Mr. Fatmir Mediu, has registered criminal proceedings for criminal offenses:
“Abuse of duty”, committed in cooperation, as well as “abuse of duty” in cooperation with a military entity, commanding staff, provided by Articles 248 and 25 of the Criminal Code and 70/2 and 2 of the Military Criminal Code, in charge of the defendant Fatmir Mediu “, it is said in the notification.
The Special Court decided to reopen the “Gërdeci” case, starting a retrial for former Defense Minister Fatmir Mediu, for the explosion in March 2008 that killed 26 people.
