New details on 21 January 2011 protest killings’ investigation

Prosecutor’s Office of Tirana has given this Monday new details regarding the ongoing investigations into the case of January 21, where four people were killed, namely, Ziver Veizi, Faik Myrtaj, Hekuran Deda and Aleks Nika.

In the official response, it is emphasized that as a function of the conducted investigations, it has been decided to evaluate and examine the “evidence seized during the investigation of the scene and the investigation of the victim, addressing the competent foreign authorities.

“Incited by the interest of various media, the Prosecutor’s Office at the Court of First Instance of the General Jurisdiction of Tirana is conducting investigative actions in relation to criminal proceedings No. 285 of 2011, (restarted), whose acts make about the event that happened on 21.01.2011, during which citizens Ziver Veizi, Faik Myrtaj, Hekuran Deda and Aleks Nika were killed.

On 18.04.2012, it was decided to separate from the criminal proceedings and send for trial to the Court of the Judicial District of Tirana, the case numbered 285/21, of the year 2012, of the materials for the defendant Ndrea Prendi accused of the criminal offense “Murder under the circumstances other qualifying offences”, carried out in a dangerous manner for the lives of many persons, provided for by article 79 letter “ë” of the Penal Code, resulting in the death of the citizen Faik Myrtaj and the defendant Agim Llupo, accused of the criminal offense “Murder in other qualifying circumstances”, committed against two or more persons”, provided by article 79 letter “dh” of the Penal Code, resulting in the death of citizens Hekuran Deda and Ziver Veizaj, as well as the injury of citizens Fatos Mahmutaj, Erald Bisha, Socrates Gode. The materials in charge of the defendant Margarit Kume, accused of the criminal offense “Actions that prevent the discovery of the truth”, provided by article 301 of the Criminal Code, have been sent for trial in this proceeding.

As a function of the investigations carried out by the judicial police, all the necessary investigative actions were carried out, but it was not possible to identify who are the persons who killed the citizens Aleks Nika and Hekuran Deda, as well as injured the citizens Fatos Mahmutaj. Sokrat Gode, Erald Bisha, Artes Dybeli, Ilia Qesko and Ilia Papa. In the conditions where all possible investigative actions were carried out and the perpetrator of the criminal offense is not known, by decision of
28.02.2020, by the Prosecutors of the case, it was decided that the investigations be suspended by passing the acts of criminal proceedings no. 285, of 2011, for further follow-up at the Tirana Local Police Directorate.

On 02.04.2021, it was decided to resume the suspended investigations and carry out investigative actions in order to discover the author of the murder of the citizen Aleks Nika, as well as Hekuran Deda, for whom the Court of the Judicial District of Tirana with decision No. 100, announced on 07.02.2013, decided the not guilty declaration of the defendant Agim Llupo, for committing the criminal offense of “Deliberate murder, committed against two or more persons”, with the consequence
directly the death of the late Hekuran Deda.

The Officers of the Crimes Against Life Section at the Local Police Directorate of Tirana have been charged with conducting the investigative actions of this criminal proceeding, who, in addition to the tasks ordered by the prosecutors in charge of the investigation, have also carried out the investigative actions delegated by the prosecutor in relation to verification of the facts published by the citizen Artan Hoxha, facts made public by him in the show “Zona Zero”, on 20.01.2023, in
“Top Channel” television.

In order to dispose of the material evidence, the audio tape, according to legal procedural requirements, the citizen Artan Hoxha, a journalist, was asked, as well as the family members of the victim Aleks Nika, who, according to the citizen Artan Hoxha, dispose of the audio materials. But in the statements given by them, it is evident that this material would not be handed over as a function of the investigations carried out by the Prosecutor’s Office at the Court of First Instance of the General Jurisdiction of Tirana,
but before the Special Anti-Corruption Structure, when this proceeding will be investigated
from them.

In the function of the investigations developed by the prosecutor, it has been decided to evaluate and examine the evidence seized during the examination of the scene and the examination of the victim, addressing the competent foreign authorities, of which, due to the sensitivity and nature of the case, it is confidentiality requested.
