Head of C.Court: Constitution guarantees rule of law

Head of the Constitutional Court of Albania, Holta Zaçaj declared Monday that although it does not do politics, the Constitutional Courts influence the political life of Albania and it guarantees the rule of law.

In a solemn session on the occasion of the 25th anniversary of the Constitution of Albania, in her speech Zaçaj focused on criticism of the judicial system, underlining that criticism is an indicator of freedom of speech, but to the extent that it does not turn into an attack or a means of pressure on them.

In the meantime, Zaçaj said that the judicial power can play its constitutional role only if it is independent.

“Constitution represents an important part of our people. Today, honoring the constitution, we honor its fathers, who dedicatedly defined democracy as the unequivocal destination. The Constitution guarantees the rule of law, represents the measuring unit to verify the protection and respect of our rights.

In the need to find the right, we all return to the text of the constitution. The constitutional court, as guardian of the constitution, is called upon to say the last word whenever necessary. This is a mission and role that constitutional judges hold with great pride and responsibility.

In the interpretation of the constitution, it respects our national values as part of universal values. During 3 decades, the Constitutional Court has influenced the development of democracy, responsible for the impact of its decision-making on social and economic life.

Its decisions constitute in themselves events of special importance. They require citizens’ reflection and are guided by the only compass, the constitution.

The court is conscious not only of fulfilling its mission, but also of the cost that this responsibility often brings. The resolution of disputes also carries the possibility of disgruntled parties.

All actors must accept its decision, the implementation of decisions is the only behavior to implement the constitution. Criticism of the court and judges are influential in the freedom of expression for which we have all fought, but to the extent that they do not turn into an attack or a means of passion against them.

The politicization of the judiciary is a phenomenon that is a constant challenge, even in countries with consolidated democracies. The constitutional reform aims to separate politics from the judiciary. Although it does not do politics, the Constitutional Courts influence the political life of the country”, stated Zaçaj.
