Apellate instance of Special Court against Corruption and Organized Crime (GJKKO) upheld this Wednesday the sentence of 3 years and 6 months in prison for the former head of crimes in Elbasan Leonard Palushi, accused of corruption, as he is suspected of serving a well-known character of the world of crime, Erjon Alibejt.
Due to the shortened trial, the sentence is reduced by 1/3, being finally sentenced to 2 (two) years and 4 (four) months of imprisonment.
Furthermore, he is prohibited from exercising public functions for a period of 5 years.
“Special Court of Appeal for Corruption and Organized Crime, with a panel composed of judges Saida Dollani (chairman), Dhimitër Lara (member) and Tereza Merkaj (member), on 27.09.2023, completed the review of the registered case with No. 47 act, date 11.07.2023 registration, on the appeal presented by the appellant/defendant L.P., against the decision No. 23, date 11.04.2023 of the Special Court of First Instance for Corruption and Organized Crime which decided :
“1. The guilty declaration of the defendant L.P. for committing the criminal offense “Passive corruption of persons exercising public functions”, provided by article 259 of the Criminal Code and based on this provision, his sentence of 3 (three) years and 6 (months) imprisonment.
2. In application of Article 406/1 of the Penal Code, 1/3 is deducted from the above measure of punishment, finally convicting the defendant L.P. with 2 (two) years and 4 (four) months of imprisonment.
3. Serving the sentence of the defendant L.P. will start from the day of his arrest and will be carried out in an IEVP, ordinary security prison.
4. Pursuant to Article 35 of the Criminal Code, the removal of the right for the defendant L.P. to exercise public functions for a period of 5 years…”
In conclusion, the Special Court of Appeal for Corruption and Organized Crime decided:
